Bihar Civil Elections: High Court said this about OBC reservations, know reaction of political parties

Neela Kamal, Patna: The OBC reservation in the elections was banned while the Patna High Court was hearing a petition against the OBC reservation in the municipal elections to be held on October 10 and 20 this month. The Patna High Court judgment says that the seats reserved for OBCs will be publicly notified and elections will be held. Apart from this, a bench of Chief Justices Sanjay Karol and S Kumar of the Patna High Court said that the State Election Commission can extend polling dates if it wants to.

Hearing the petition, the court stated that the state government had given reservation to EBCs without the triple test as per the Supreme Court judgment. The Patna High Court ruled that reservation for OBCs in local bodies cannot be granted until the government completes three inquiries issued by the Supreme Court in 2010.

Janata Dal United’s Parliamentary Board Chairman Upendra Kushwaha said the High Court’s decision was unfortunate after the Patna High Court banned OBC reservation in municipal elections. He said that such a decision is the result of the conspiracy of the central government and the BJP. Upendra Kushwaha said that if the Narendra Modi government at the Center had conducted the caste census on time and completed the necessary constitutional procedures, this situation would not have happened today.

Upendra Kushwaha said that the census conducted or implemented by the state government can only be used to inform government schemes. If the government uses it on a constitutional issue, tomorrow some court will go again and the court will say that it is not constitutional. Upendra Kushwaha also said that this will happen because there is a collegium system.

A move against the BJP on the reservation issue
JD(U) Parliamentary Board President Upendra Kushwaha has said that his party will protest against the central government’s and BJP’s conspiracy regarding OBC reservation in civil body elections. Upendra Kushwaha also took a jibe at Sushil Kumar Modi’s statement, saying where the data comes from or could come from without a caste census called a dedicated commission. Upendra Kushwaha said that the government has the same figure of 1931 which the High Court and the Supreme Court have refused to accept many times. Upendra Kushwaha mocked Sushil Kumar Modi and said that he should not talk back and forth and tell the high command to conduct the caste census as soon as possible.

Former Bihar Deputy Chief Minister Sushil Kumar Modi said that Patna High Court’s order to stop OBC and EBC reservation in municipal elections was a result of Nitish Kumar’s stubbornness. He said that Nitish Kumar rejected the Supreme Court’s suggestion to conduct a triple test. Sushil Kumar Modi has also asked Nitish Kumar to stop the election immediately. Sushil Modi also said that caste census has nothing to do with municipal elections. The court said that a dedicated commission should be constituted and its recommendation should be reserved. But Nitish Kumar stuck to his insistence.
